Terms of Service

These terms govern your use of ChurnWin ("the Service"), operated by ChurnWin ("we", "our", "us"). By using ChurnWin, you agree to these terms.
1. Account Registration
To use ChurnWin, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old or have the authority to bind your organization to these terms.
2. The Service
ChurnWin provides churn analytics, customer risk scoring, and automated feedback collection for Stripe-based SaaS businesses. The Service requires you to connect a Stripe account via an API key that you provide.
3. Stripe API Keys
You are responsible for the API keys you provide to ChurnWin. We recommend using restricted read-only keys with minimal permissions. ChurnWin will only read data from your Stripe account — we will never create charges, modify subscriptions, or alter any Stripe data.
4. Emails Sent on Your Behalf
ChurnWin can send feedback request emails to your customers when they cancel. By enabling this feature, you confirm that:
- You have the right to email these customers
- The emails comply with applicable laws (CAN-SPAM, GDPR, etc.)
- You accept responsibility for the content of customized email templates
Default email templates are provided as a starting point. You may customize them, but you are responsible for ensuring your customized content is appropriate and lawful.
5. Billing and Subscriptions
Paid plans are billed monthly via Stripe. All plans include a 7-day free trial. You can cancel at any time — your access continues until the end of the current billing period. Refunds are handled on a case-by-case basis.
6. Usage Limits
Each plan has limits on the number of Stripe accounts, customers, and emails per month. If you exceed your plan limits, you will need to upgrade to continue using those features. We will notify you before any limits are reached.
7. Data Ownership
Your Stripe data remains yours. ChurnWin processes your data to provide analytics and insights, but we do not claim ownership of your customer data, subscription data, or any content you create within the platform (e.g., email templates).
8. Acceptable Use
You agree not to:
- Use ChurnWin for any unlawful purpose
- Attempt to reverse-engineer, decompile, or access the source code
- Use the Service to send spam or unsolicited commercial emails
- Share your account credentials with unauthorized third parties
- Interfere with or disrupt the Service or its infrastructure
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with advance notice when possible. We are not liable for downtime caused by Stripe API outages, internet disruptions, or force majeure events.
10. Limitation of Liability
ChurnWin is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue, lost data, or business interruption. Our total liability is limited to the amount you paid for the Service in the preceding 12 months.
11. Termination
You may close your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted within 30 days as described in our Privacy Policy.
12. Changes to These Terms
We may update these terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use after changes constitutes acceptance.
